Law Punishing Fake Military Heroes May Go to Supreme Court - FoxNews.com


DENVER -- The Justice Department is battling to save a federal law that makes it illegal to lie about being a war hero.

A federal appeals court in California and a federal district court in Denver have both ruled the Stolen Valor Act is unconstitutional under the First Amendment, which protects freedom of speech.

Government lawyers in California have asked the appeals court to reconsider its ruling. Prosecutors in Colorado say they also will file an appeal.

The law makes it a crime punishable by up to a year in jail to falsely claim to have won a military medal.

Critics say the law gives the government too much power to determine what kind of speech is legal, and that impostors can be punished under existing fraud laws. Supporters say the law defends the honor of legitimate war heroes.

It is fraud and should be punishable by a lot more than just one year in prison.

Exactly. it is a huge slap in the face to the people who really did win medals. I bet my g-paw is rolling over in his grave right now.

I say anyone caught lying about being a war hero should only get a week. It will be simple they get dropped out in the sandbox or the jungle. They get the following things, A compass, a map, a gun, a knife, a canteen, 3 MRE's. If they make it to the extraction point no harm no foul they can go on with the rest of their lives. If they don't make it to the extraction point, no harm no foul, but they will understand what those people that EARNED those medals went through before they die.

Especially those that did give there lives. I myself was never in the military, but have absolute respect for them. And also understand, that I will not be able to understand the things that our people in war went through. It is sickening to think that there are these frauds running around.

This is a joke right? Like they cannot be serious. I really hope this is a joke or else I have no faith in the US Court System (well... what little i had is now gone)

I didnt get no Medal of Honor or anything but all of my awards i did get i earned the hard way. I was blown up on Feb 12, 2007 shrapnel to the legs, right bicep, and right eye. Was ejected 35 ft out of the truck and jacked up my back. And the thing that pisses me off the most is that some fat f#(k 200 meters away from an IED gets a purple heart as well cuz he quote, unquote, was knocked out from the blast. Sorry about the vent but i think that is bull shet as well. Basically they need to rethink the whole awards thing and fine the shet out of people who fake getting an award.
