Dr. Jack Cassell told Fox News on Monday that the health care plan signed into law last month will hurt his ability to care for patients and urged other doctors to "take a stand" on the issue.
"I think there's a real, real problem that's going on here in this country and unfortunately Obamacare fatally compromises my ability or any doctor's ability to uphold the Hippocratic Oath," he said. "I mean, I can't believe that more people aren't standing up. I think all the doctors in the United States need to take a stand on this, because pretty soon it's going to be too late."
The notice on Cassell's Mount Dora practice says, "If you voted for Obama, seek urologic care elsewhere. Changes to your healthcare begin right now, not in four years."
Cassell told Fox News on Friday he wasn't literally refusing care to patients but wanted to educate them on how the new health care law would affect them.

The congressman will also file additional complaints with all relevant boards or agencies, Grayson spokesman Todd Jurkowski said.
"I think a reasonable person would deem that being turned away," Jurkowski said.
A University of Florida professor said Cassell is walking a thin line between free speech and professional obligation. William Allen, a specialist in bioethics, law and medical professionalism, said civil rights protections can prevent patient discrimination. But the law only provides for race, gender, religion, sexual orientation and disability -- not political opinion.
Allen said Cassell may be within his rights if he doesn't quiz patients about their politics and hasn't refused to see anyone.
A spokeswoman from the Florida Department of Health, which licenses physicians and investigates complaints, said Friday there was no law prohibiting Cassell from advertising himself this way.
"Because there is no statute, there would be no grounds for a complaint," spokeswoman Eulinda Smith said. "It would be legally deficient."
Cassell has been practicing in the area since 1988. His wife, Leslie Campione, is a lawyer and GOP candidate for the county commission.

I guess because I'm in Myrtle Beach playing golf with my wonderful wife.

After reading it, I agree with the professor.

He probably is walking a thin line between free speech and professional obligation. If he actually refused someone, after they verbally told him they voted for Obama..........he would be in deep doo-doo. As it is, all he's done is post a sign hoping to scare away patients and hasn't actually refused them care.

I say let the courts settle it.

Never have so many politicians, screwed so many Americans...just to make one black person lose his job.

WAIT, he can't refuse to see someone? Why not? I thought that was the whole premise behind the healthcare bill. One can go to the hospital to get treatment but try to go to a primary care or specialist and you could be turned away.

The way it is now, you can be turned away for not having health insurance or the cash to pay.

Not because of your political views.

Never have so many politicians, screwed so many Americans...just to make one black person lose his job.

Not if one receives any public funding....so if you accept medicade, medicare, receive subsidies one cannot turn away patients.

And why can't you turn away someone based upon their political views? That is not a protected class.

That's not entirely true.

Maybe for emergency procedures............yes.

But, no doctor is required to accept new patients for ongoing/routine care if they cannot show an ability to pay.

My wife, who is in the health care field and has one of her masters in hospital management, just came across a woman who was in a car crash.

Due to the accident, she had her jaw wired shut because it was broken. Now she can't find anyone who will take the wires out because..............it's no longer an 'emergency.'

I ask....................what kind of chit is that?

What does your example have to do with health insurance? Auto insurance should be covering the issues from the car crash or did the lady also refuse to be medically covered by her auto insurance? Not sure if one can do that in FL but here in GA one can decline medical coverage on their auto insurance.

Should we be required to subsidize this woman's auto insurance so she is properly insured? Slipery slope isn't it?

She was a passenger and the driver did not have medical coverage (PIP).

As I've said before though, I believe every American citizen should be able to get health care.

So she was riding with someone who wasn't properly covered and she wasn't properly covered. At what point does it become her problem and not mine or the doctors? You know, that whole personal responsibility thing.

I believe every American citizen should be able to GET health insurance. I do not believe every American citizen should be FORCED to get health insurance. And I sure as heck don't believe I should be subsidizing someone elses health insurance when we are barely keeping it together to afford our own.
