According to MyFoxBoston.com, on November 10th, 29 year old Anthony McKay came upon 29 year old Christian Johnson rummaging through Mckay's truck. McKay keeps his tools in his trucks for work. When McKay confronted Johnson, Johnson pushed McKay away and reached into his back pocket. Fearing that the thief was going for a weapon, Anthony McKay struck Christian Johnson once across the face. After the thief fell, McKay held the man down and told his fiance to call the police. During this time, McKay's fiance and three children were inside the home.

When the Swampscott police arrived, they arrested Christian Johnson. The thief was carrying a large knife and police like batton in his back pocket. In addition, he was found with a pipe that is suspected as being for the drug heroine. Christian Johnson did suffer a broken jaw from the punch to the face. Several hours later, the Swampscott police came back to McKays home and arrested the 28 year old father of three. They charged him with assault and battery.

On November 18th, Anthony McKay was arraigned in district court this afternoon, where McKay's lawyer expected the District Attorney to drop the charges. In a stunning swerve, District Attorney Jonathan Blodgett raised the charge to an aggravated assault, which is a felony charge and can land Anthony five years in prison.

First mistake was calling the police. Second mistake was leaving the attacker breathing. Just sayin.....

My feeling he did the right thing. This is an insane story. Unbelieveabe, prisoner rights trump civilian rights.

If many of you have never watched "I Survived" on the Bio channel, you all should watch a few episodes. Prisoner or criminal rights almost always trump the victims rights. It is so bass ackwards!

I've seen similar things happen but it depends on the voting populous. In more conservative counties it would be less likely to happen but in a more liberal county, the prosecutors 2nd guess the rights of victims to protect themselves. It becomes more of be a good witness/victim and call the police.
A guy out here was nearly charged after he was mugged and shot at 2 of his attackers. There had been 6-7 different armed muggings in the area and it appeared that played a part in charges being declined.

In this case, it may depend on state law. In TX you can use force to include deadly force to protect yourself, 3rd person or property. It has to be justifiable but in certain cases the case may be forwarded to the DA for review.

If that's gonna be the norm they think jails are crowded now? They better kick out some drug dealers murderers n pedophiles, to make room for more hardcore criminals....like regular folk tryin to protect our property n lives of our families

The story is very true and all too common on the East Coast.
At the site below their are links for several news stories on this.
Jonathan W. Blodgett, Essex County DA: Drop all charges against Anthony McKay
Obviously this is also a petition asking the Essex county DA to drop all charges against Anthony. Please take a look at all the information. If you agree, sign the petition and then share it on your facebook and twitter accounts.
There is also a link there for another petition for trying to get the MA Senate Bill 661 passed so that hopefully in the future we don't have more Anthony McKay stories.

Thanks for the link sreneel77. I signed. There were 3 other petitions to sign as well (I signed 1 of the 3), all liberal causes.

Just being charged with a crime, not even a conviction, is extremely expensive, stressful, job endangering, and life altering. That DA has already irrevocably changed this man's life by charging him w/ a crime.

There are a lot of things that happen everyday that just go against common sense, and this is one of them.

I'm officially...Stroke-less.
