Brakes stay on

So over night somehow the brake lights come on. Now I have noticed that while driving I have to lift the brake pedal up with my toes or the brakes will stay on while driving. Any ideas??

Fluid was low topped it off, pedal stiffened up, and now returns on it's own. Will have to watch for leaks over the next couple of days.
